1. The service
Otobiz lets a business receive customer messages across channels (such as WhatsApp, Instagram, Messenger, Telegram, SMS, email, and web chat), reply to them with help from a team and an AI assistant, run broadcasts and automations, and track the results in one workspace. We provide the tools; the messages you send, and the audiences you send them to, are yours.
2. Accounts and eligibility
You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your workspace and for your team members' use of the service. You must be legally able to enter a contract and use the service in compliance with the laws that apply to you.
3. Your responsibilities — rights and consent
You are solely responsible for the customers you message and the content you send. You represent and warrant that:
- Rights and consent — you have the necessary rights, permissions, and valid opt-in consent to contact each recipient on the channel you use, and you honor opt-out and unsubscribe requests promptly.
- Lawful use — your messaging complies with all applicable laws and regulations, including those governing marketing, privacy, and electronic communications (for example anti-spam, telemarketing, and data-protection laws).
- Platform rules — your use complies with the terms and policies of the channels you connect, including the Meta/WhatsApp Business messaging policies and Instagram's platform policies.
- Accurate data — the order status, customer records, and other data you feed the AI to answer from are accurate; the AI answers from your data and does not invent facts.
4. Acceptable use
You agree not to use the service to:
- Send spam, unsolicited bulk messages, or messages to people who have not consented or have opted out.
- Send unlawful, deceptive, fraudulent, harassing, hateful, or otherwise abusive content.
- Impersonate any person or business, or misrepresent who is sending a message.
- Distribute malware, run phishing or scams, or attempt to breach the security of the service or any other system.
- Infringe intellectual-property or privacy rights, or violate any applicable law or third-party platform policy.
- Resell, scrape, reverse engineer, or overload the service, or circumvent its usage limits or safeguards.
We may suspend or terminate access that we reasonably believe violates these Terms or puts the service, its users, or a connected platform at risk.
5. Automation and human-approval boundaries
The AI assistant drafts and, where you enable it, sends routine replies from your own workspace data. By design, sensitive, uncertain, payment-related, broadcast, and spend-related actions are held for a human on your team to review and approve before they go out. You control which automations are enabled.
Because automated and AI-assisted messages can be imperfect, you are responsible for reviewing your automation settings and for the messages sent from your workspace. The AI assistant is a tool to help your team, not a substitute for your judgment, and we do not guarantee that any automated reply is accurate, complete, or appropriate for a given situation.
6. Customer data and privacy
Your workspace content and your customers' data belong to you; you grant us the rights needed to host and process it to provide the service. Our handling of personal data is described in the Privacy Policy, which forms part of these Terms. You are responsible, as against your end customers, for having a lawful basis and any required notices or consent for the data you bring to the service.
7. Third-party platforms
The service connects to third-party platforms (such as Meta's WhatsApp, Instagram, and Messenger, and other channels). Your use of those platforms is also subject to their own terms and policies, and their availability is outside our control. We are not responsible for a third-party platform's actions, outages, or changes to its APIs.
8. Plans and fees
You can start for free. If you subscribe to a paid plan, the applicable fees, billing period, and terms will be presented at purchase. Third-party platforms may charge their own messaging fees (for example WhatsApp conversation charges), which are your responsibility.
9. Intellectual property
Otobiz, including its software, design, and brand, is owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You keep ownership of your content; we keep ownership of the service.
10. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that automated replies will be accurate.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim.
12. Termination
You may stop using the service and close your workspace at any time. We may suspend or terminate access for violation of these Terms, non-payment, or to protect the service or its users. On termination, your right to use the service ends; sections that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will survive. Data deletion follows the Privacy Policy.
13. Changes to these terms
We may update these Terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you. Continued use of the service after an update means you accept the revised Terms.
